Tort and Product Liability Law
The history of Tort Law in Switzerland has been one of continuous tightening in both legislation and court rulings. Regardless of the business activity pursued, questions of Tort Law must not be neglected nowadays. The addressing of such issues and an effective prevention of liability situations represent crucial elements of an enterpreneurial risk management.
In Tort Law in general and in Product Liability Law in particular the legal developments in Switzerland as well as in other jurisdictions were to a lesser extent a matter of court decisions, but rather one of out of court settlements (between plaintiff and defendant and/or insurances). Longstanding experience enables us to competently support our clientele in identifying potential risk timely and in warding off or asserting liability claims in a litigation setting.
Our activities cover the full spectrum of contractual liability and tort law for products and services. We also feel confident when coping with issues of international private law and issues arising from foreign law.

Was hat Philip Morris USA, Inc. v. Williams mit unserer Rechtsordnung zu tun ?
Am 31. März 2009 hat sich der U.S. Supreme Court ein weiteres Mal im Streitfall Philip Morris vs. Williams ausgesprochen (Philip Morris USA, Inc. v. Williams, 07-1216). Das oberste amerikanische Gericht entschied, dass Mayola Williams rund USD 80 Mio. an Schadenersatz und punitive damages (Strafschadenersatz, der über den erlittenen wirtschaftlichen Schaden hinausgeht) in ihrem Kampf gegen den Zigarettenhersteller Philip Morris zustehe. ... lesen
